These Terms of Service ("Terms") govern your access to and use of the website sculpette.com (the "Site") and your purchase of any products from it. The Site is operated by Flexnee LLC, a California limited liability company, doing business as Sculpette ("Sculpette", "we", "us", "our"). By using the Site or placing an order you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use is yours or that you are authorized to use it.

2. Accounts

You may check out as a guest or create an account. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you believe your account has been accessed without permission. We may suspend or close accounts that breach these Terms.

3. Products and product information

We try to describe every product accurately, including size, shade, dimensions and care. Shades are shown as accurately as screens allow, but colors vary between devices and we cannot guarantee that what you see matches the product exactly. Sizes are guides based on cup volume; use the size guide before ordering. Product availability, specifications and prices may change without notice. We may limit quantities per order or per customer and may discontinue any product at any time.

4. Health and safety notice

Our products are adhesive silicone and adhesive fabric items applied directly to the skin. They are not intended for individuals with sensitive, thin, damaged or broken skin, or for anyone who is pregnant or breastfeeding. Do not use on sunburned skin or over any wound or rash. Follow the application and removal instructions on the product page and on How to wear. If you experience irritation, redness, itching or discomfort, remove the product immediately and discontinue use. Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any condition. Nothing on the Site is medical advice. If you have a skin condition or are unsure whether adhesives are suitable for you, consult a healthcare professional before use.

5. Pricing and payment

All prices are in US dollars and exclude sales tax, which is calculated at checkout based on your delivery address where applicable. We accept the payment methods shown at checkout. Payment is taken when your order is placed. In the event of a pricing error we may cancel the affected order and refund you in full, even after an order confirmation has been sent. Prices shown as "compare at" or crossed out are the regular price of the items bought separately or at full price.

6. Orders and acceptance

Your order is an offer to buy. It is accepted when we ship the products and send you a shipping confirmation. We may refuse or cancel any order, including where a product is unavailable, where we suspect fraud or resale, where the order breaches these Terms, or where we cannot verify your address or payment. If we cancel an order after payment, we refund you in full. We may contact you to verify details before shipping.

7. Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Returns, exchanges and refunds are governed by our Return and Refund Policy. Both form part of these Terms. Risk of loss passes to you on delivery to the address you provided.

8. Discount codes and promotions

Discount codes are valid only for the period and conditions stated, cannot be combined unless we say otherwise, cannot be applied after an order is placed, and have no cash value. Free gifts and gift-with-purchase offers are subject to availability and may be substituted. We may withdraw or modify any promotion at any time, and may cancel orders that abuse a promotion, including through multiple accounts or codes not intended for public use.

9. Intellectual property

The Site and everything on it, including text, photographs, graphics, product names, the Sculpette name and logo, page layouts and code, are owned by or licensed to Flexnee LLC and protected by copyright, trademark and other laws. You may view and print pages for personal, non-commercial use. You may not copy, reproduce, republish, scrape, frame, distribute or create derivative works from any part of the Site without our written permission.

10. Third-party brands and comparisons

Sculpette is an independent brand. Other brand names that appear on the Site, including in comparison pages, are the trademarks of their respective owners and are used only to identify those products for comparison. Sculpette is not affiliated with, endorsed by or sponsored by any of them. Comparison information is taken from those brands' public websites on the date stated on the page and may change; we do not guarantee its ongoing accuracy.

11. Reviews and user content

If you submit a review, photo, comment or other content, you grant Sculpette a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit and display it in connection with the Site and our marketing, with or without your name. You confirm that the content is yours, is truthful, does not infringe anyone's rights, and does not contain anything unlawful or offensive. We may remove any content at our discretion. Reviews reflect the individual experience of the reviewer and are not a guarantee of results.

12. Acceptable use

You agree not to use the Site for any unlawful purpose; to attempt to gain unauthorized access to any part of it; to introduce viruses or harmful code; to use automated tools to scrape, crawl or extract data; to interfere with its operation; to impersonate any person; to place fraudulent or speculative orders; or to resell products bought on the Site without our written consent.

13. Third-party links and tools

The Site may contain links to third-party websites and use third-party tools such as payment processors, tracking services and review platforms. We are not responsible for the content, policies or practices of any third party. Your use of those services is governed by their own terms.

14. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

15. Disclaimer of warranties

To the fullest extent permitted by law, the Site and the products are provided "as is" and "as available". We do not warrant that the Site will be uninterrupted, error-free or secure, or that the products will meet your specific expectations of fit, hold or appearance, which depend on individual factors including skin type, body shape and application. All implied warranties, including merchantability and fitness for a particular purpose, are disclaimed to the extent permitted by law. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, Flexnee LLC, its members, managers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Site or the products, whether in contract, tort or otherwise. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

17. Indemnification

You agree to indemnify and hold harmless Flexnee LLC and its members, officers, employees and agents from any claim, loss or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

18. Governing law and disputes

These Terms are governed by the laws of the State of California and applicable federal law of the United States, without regard to conflict-of-law rules, and subject to any mandatory consumer protection law of the state in which you live that cannot be excluded by agreement. Before starting any formal proceedings, you agree to contact us and give us 30 days to resolve the issue. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction, except that you may bring an eligible claim in the small claims court of your county of residence. Nothing here prevents you from exercising rights under your local consumer law.

19. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site at the time you place an order applies to that order. Continued use of the Site after changes are posted means you accept the updated Terms. The "last updated" date at the top shows when the current version took effect.

20. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between you and us regarding the Site and your orders. You may not assign your rights under these Terms; we may assign ours to a successor of the business.
